1042-S Forms
Foreign nationals elected for the tax treaty benefits will receive a 1042-S Form from the State of Kansas, usually during March after the year they elected to use the tax treaty benefit. At K-State, these forms are distributed by the State of Kansas and are now available electronically through the State of Kansas Employee Self-Service. Unless employees opt to receive their 1042-Forms electronically, forms will be mailed to the address on file within HRIS.
Employees will need to use the 1042-S Form, along with their passport, visa, I-20 or DS-2019, and I-94, to complete the 8843 and 1040-NR forms to file taxes. You are strongly encouraged to complete these forms. In addition to the possibility of receiving a tax refund, failure to file a tax return may make it difficult to obtain future visas to the United States. Please make sure to use the Sprintax Prep Software to complete your tax return. Instructions on using Sprintax can be found on the International Student and Scholar Services (ISSS) website. International Student and Scholar Services (ISSS) will offer a number of workshops between January and the April tax due date for employees who need help completing the form. The exact time, date, and location of these workshops will be emailed out to employees through their offices.
Note: If employees also had taxes deducted from paid employment, a W-2 Form from the State of Kansas will be issued. Employees will need to use the W-2 Form to complete their tax return through Sprintax.
