KBOR alignment of notices of non-reappointment

The Kansas Board of Regents approved a new notice of non-reappointment, or NNR, policy for non-tenure track faculty and staff across all KBOR institutions at its January meeting. The policy amendments align all KBOR institutions to a maximum 90-day notice period for non-tenue track employees.

Amendments to the policy provide that any notice procedures for non-reappointment for all classes of employees other than tenured or tenure-track faculty members may be determined by the institutions chief executive officer, subject to the limitation that the service end date in any notice of non-reappointment shall not exceed 90 days from the date of the notice of non-reappointment.

The existing policy for tenure-track faculty will remain unchanged.

K-State developed PPM 4050 Notice Procedure for Non-Reappointment, effective July 1, 2024. This policy specifies the employee classifications impacted by this policy, the NNR procedure and the limited exceptions. 

PPM 4050 applies to non-tenured or non-tenure track unclassified employees on regular appointments (as defined in PPM Chapter 4650, .050 for unclassified appointment types), including unclassified administrative personnel hired on or after July 1, 2024. The notice procedures for non-reappointment for this classification of employees shall be 90 calendar days from the date of the notice of non-reappointment. 

Unclassified employees with the same distinction above (i.e., non-tenured or non-tenure track unclassified employees on regular appointments) hired before July 1, 2024, will remain subject to existing university handbook policies through June 30, 2025, after which date all such unclassified employees will be subject to the same 90 calendar days’ notice of non-reappointment.

Why did KBOR amend the policy on non-reappointment? 

The Kansas Board of Regents amended the board policy on non-reappointment of university employees other than tenured and tenure-track faculty in order to standardize notice requirements across institutions. 

Who is impacted by the change? 

The board policy on non-reappointment includes procedures for two employee groups: tenure-track faculty and all other classes of employees. The existing policy for tenure-track faculty will remain unchanged. Policy changes will impact all other classes of employees, including employees on regular appointments (unclassified administrative or service) and non-tenure track faculty on regular appointments. 

Employees on term or temporary appointments are not subject to the proposed policy amendments. 

When will the new policy go into effect? 

The KBOR policy was approved by the Board of Regents during its January 2024 meeting. K-State developed PPM 4050 Notice for Non-Reappointment in response to and for alignment with the KBOR policy,effective July 1, 2024, for all new hires on or after this date. The policy is effective July 1, 2025, for all other similarly classified employees regardless of their hire date. 

What policy and procedure pertains to me? 

As detailed in PPM 4050, this policy applies to all non-tenured and non-tenure track faculty and unclassified professionals on regular appointments. Any unclassified employee hired on or after July 1, 2024, will be subject to a 90-day notice of non-reappointment as detailed in PPM 4050. Any unclassified employee hired before July 1, 2025, will be subject to existing university handbook policies until July 1, 2025, after which date all such unclassified employees are subject to PPM 4050 and the same 90 calendar days’ notice of non-reappointment.  

What was the university’s approach to align with KBOR policy? 

K-State established a working group to develop a recommendation to the president, which included removing the notice of non-reappointment language from the University Handbook and creating a chapter in the K-State Policies and Procedures Manual. Membership of the working group includes:

Will the annual non-tenured/non-tenured track faculty evaluation process change as a result of the implementation of the new policy? 
No. The annual evaluation process remains. 
Does the new policy change the timing of the reappointment process for non-tenure-track faculty change? 
The annual reappointment process for non-tenure-track faculty dictated in the handbook remains in effect, other than the specific changes on notification introduced in the new policy. 
Will these changes impact the annual employee contract process? 
The contract process will remain as-is with plans to further review and align in the future.
