Notice Procedure for Non-Reappointment

.010 Introduction
Pursuant to Kansas Board of Regents (KBOR) policy, Kansas State University (“University”) may provide a notice for non-reappointment (NNR) as detailed below.
.020 Scope
This policy applies to non-tenured or non-tenure track unclassified employees on regular appointments (as defined in PPM Chapter 4650, .050 for unclassified appointment types), including unclassified administrative personnel.
A notice for non-reappointment is generally appropriate due to various situations, including but not limited to, impacts resulting from a reorganization/restructure or budget constraints.
.030 Non-reappointments
Any notice procedures for non-reappointment for unclassified employees on regular appointments (other than tenured or tenure-track faculty members, and unclassified administrative or service employees on term or temporary appointments), hired on or after July 1, 2024, shall be 90 calendar days from the date of the notice of non-reappointment. For this class of employees, this policy subsection amends and supersedes the existing university handbook policies with respect to these specific notice procedures.
Unclassified employees with the same distinction above (i.e., non-tenured or non-tenure track unclassified employees on regular appointments) hired before July 1, 2024 will remain subject to existing university handbook policies through June 30, 2025, after which date all such unclassified employees are subject to the above paragraph and the same 90 calendar days’ notice of non-reappointment.
As a result of this policy, the annual evaluation and reappointment process as detailed in the University handbook remains in effect for this classification of employees.
.040 Process
- Department head or university administrator contacts Employee Relations and Engagement in Human Resources to discuss NNR request.
- Human Resources reviews the request and advises the department head on communication and appropriate steps if the decision is made to provide the NNR.
- Advanced notice of the non-reappointment decision may not be given to the employee, as such action may result in a violation of KBOR and University policy.
.050 Notice Exceptions
The only exceptions to this Notice of Non-reappointment policy are as follows:
- A conflicting applicable Board-approved collective bargaining agreement that provides for a longer notice period.
- A conflicting applicable Board-approved university support staff system of administration plan developed pursuant to K.S.A. 76-715a that provides for a longer notice period.*
- The University’s President determines that a longer notice period is warranted in an individual circumstance.
*USS employees are exempt from this policy; however should a USS position convert to an unclassified role, this policy applies.
